These Terms and Conditions (“Terms”) govern your use of the K9 Dispatch (“the Provider”) website located at www.k9dispatch.co.za (“the Website”). By accessing or using the Website, you (“the User”) agree to be bound by these Terms.
The User may not copy, reproduce, distribute, display, download, deep-link, embed or otherwise use any content from the Website for commercial or marketing purposes without the Provider’s prior written consent. Unauthorised use may constitute a breach of copyright, trademark or other applicable South African laws.
1. Electronic Communications
By using the Website or communicating with the Provider electronically, the User acknowledges and agrees that all agreements, notices, disclosures and communications satisfy any legal requirement that such communications be in writing, in terms of the Electronic Communications and Transactions Act, 2002 (“ECT Act”).
2. E-Commerce & Privacy
The Website sells pet-related products and accessories (“the Products”). Use of any Product purchased from the Website is at the User’s own risk. The User indemnifies the Provider against any loss, injury or damages arising from the use of the Products.
The Provider processes personal information in accordance with the Protection of Personal Information Act, 2013 (“POPIA”). Personal information required to process orders—such as name, delivery address, contact details and payment information—is kept strictly confidential and will not be sold or disclosed to third parties except where required to fulfil an order (e.g., couriers requiring the delivery address and contact number).
The Provider does not store credit card details under any circumstances. Payments are processed securely via PayFast (https://payfast.io), and Users are encouraged to review PayFast’s security policies.
The Provider cannot be held liable for any security breaches on the User’s device resulting from malware, spyware or insufficient security software.
Goods are supplied to the chosen courier in good order. The Provider cannot be held responsible for the condition of goods upon arrival at the User’s selected delivery address once handed over to the courier.
3. Warranty and Returns Policy
All Products are subject to availability. If a Product becomes unavailable, the User will be refunded in full within 30 days.
Manufacturer warranties apply to all Products.
Before returning any Product, the User must first contact the Provider for return instructions.
If a Product becomes faulty within the warranty period, it may be returned for assessment, repair or replacement. The manufacturer or authorised distributor will determine, at their discretion, whether the warranty claim is valid. Their decision is final.
Unwanted Products may be returned within 14 days of receipt, provided they are unused, in original packaging and include all accessories and documentation.
Cancellations by the User may be subject to a 15% administration fee.
The Provider reserves the right to cancel an order after payment has been received if stock is insufficient or if the quality of the Products does not meet the Provider’s standards. In such cases, the User will receive a full refund with no deductions.
Complaints relating to Product quality or service must be directed to orders@k9dispatch.co.za.
4. Updating of Terms
The Provider reserves the right to amend these Terms at any time. Changes become effective once published on the Website.
It is the User’s responsibility to review the Terms periodically. Continued use of the Website constitutes acceptance of the amended Terms.
5. Copyright and Intellectual Property
All content displayed on the Website—including text, product information, software, graphics, images and compilations (“the Content”)—is owned by the Provider, its affiliates, or relevant third-party owners. Content is protected by South African and international copyright laws.
The Provider may amend the Website, its Content, or any Products or Services offered without prior notice.
Except as expressly permitted in these Terms, the User is not granted any licence or rights in the Content, including intellectual property rights.
6. Limitation of Liability
The Website and all Content are provided on an “as is” and “as available” basis. The Provider makes no warranties regarding availability, accuracy or completeness.
Neither the Provider nor its affiliates shall be liable for any direct, indirect, incidental, consequential or other damages arising from:
- the use of the Website or Content,
- the inability to access the Website,
- any linked websites or third-party services,
- or any errors or omissions.
Use of the Website is at the User’s own risk.
7. Privacy: Casual Surfing
Users may browse the Website without providing personal information. Website servers may collect the User’s IP address for analytics purposes such as measuring visits, browsing duration and pages viewed. This aggregated information may be used to improve the Website and may be copied or distributed without restriction.
8. Choice of Law and Jurisdiction
The Website is operated within the Republic of South Africa. Access from jurisdictions where the Website or its Content is illegal is prohibited.
These Terms are governed by South African law.
In the event of any dispute, the User consents to the jurisdiction of the Western Cape High Court.
If any provision of these Terms is found unenforceable, it will be applied to the maximum extent permissible, and the remaining provisions shall remain in full force.
These Terms constitute the entire agreement between the Provider and the User regarding use of the Website and its Content.
